Brain-Damaged Child's Family Mulls Life And Death

See here, there is always hope. There is always hope. And the doctors are wrong...often.

Thor had a car accident 11 years ago. He was in a coma for months and impaired by brain damage.

At one point Thor told his mother, "If this is what my life is going to be like, Mom, I don't want it." What if it came down to making that decision? Would Thor want to live or die? No one mustered the courage...until this Easter.

The whole family got together (some via phone) to get Thor's matter resolved clearly.

What does Thor's mother think about 'quality of life'?
She has her own strong opinions about what makes a life worth living and when to say "enough." When doctors over the years asked if she would want to sign a do-not-resuscitate order on Thor's behalf, the answer was always, "Absolutely not."
A great quote from her: "If you kill all hope, then you'd never see miracles."

Now, Thor is not leading an easy life.
He is legally blind, deaf in one ear and suffers memory loss. He has endured bouts of pneumonia that put him back on a ventilator, and an agonizing procedure to drain spinal fluid. Though he can talk, his speech is badly distorted. Knowing that, his family watches his lips as he searches for the right words.
So, what are Thor's wishes? I would think his previous comment would make it clear, right.

"I don't want to die."

Are you sure, Thor? "Whatever it takes," Thor replies, speaking slowly to enunciate each syllable. "An-y-thing."

What about if there is a need for extrodianary intervention? "I'd rather be alive than dead."

What about that now infamous "Vegetative State?" "I'd rather have that, too,"

Thor, while brian damaged does also understand how wrong doctors can be.

The said he might never speak again and he does. He would never walk, they said, but he does.

"They were wrong," he says. "They were wrong every time. So, don't make that decision from what they say."

You see, Thor's comment about not wanting the life as it is comes from a natural reaction during adversity. The same way a new runner might say they cannot finish their run or how people proclaimed after 9/11 that they would never fly again, people deny what they are willing to overcome. They doubt their strength in adversity often while proving themselves wrong.

How many movies, stories and anecdotes have a person who is re-learning to walk proclaim, "I can't"? It happens naturally and is not indicitive of a person's true beliefs, wishes or abilities.

We cannot take as word of fact these types of flippant remarks...ever. It is not evidence enough and should never be taken as such again.

The more I hear of him the less I like him

Today Terri died but lingering are many questions that the nation must answer and many issues from Michael Schiavo that make him more detestable.

He ordered the blood relatives out of the room just before she passed. He claims because Terri's brother was causing acrimony. Considering how heartless Michael has been through the whole ordeal I tend to believe that he was being black-hearted and spiteful.

Michael wants the body creamated and buried in his family's plot in Pennsylvania. Why? If he really loved her so much then why not try to make amends with the family? Why the two serious girlfriends and two bastard children while married to Terri? Why not demand investigations into the broken bones that Terri received?

None of those things are coming from Michael. I do not believe the decision to take Terri's remains is anything more than hateful motivation to hurt Terri's caring family. I believe that the decision to have the body creamated is to make certain that anything not discovered during the autopsy disappears forever.

Read the story for yourself. You may disagree with me...but I am not changing my position on this. I have read hundreds of pages of documents that make me believe this way about Terri, Michael and the whole situation. Only a couple of pages of documents have caused any doubt in my mind about my assessment of Michael's character.

Should it be tax-exempt?

A long time ago there was an Indian tribe in New York that signed a treaty that gave them some 300,000 acres and sovereignty. That was 1794 when the Treaty of Canandaigua gave the tribe "free use and enjoyment" of the land.

Some parcels of land were transfered from the tribe to a member of the tribe in 1805. He then sold the land in 1807 to "a non-Indian". For a while they remained owned by "non-Indians" until finally the tribe "reacquired them in open-market transactions." For nearly 200 years the governance of that land laid with the State, county and municipalities.

The catch is that the land in question lies within the boundaries of the reservation originally occupied by the tribe. Therefore the tribe said that the property taxes could not be collected from the tribe in accordance with the treaty.

Now, what do you think the Supreme Court ruled on Tuesday?

I'll give you a hint, Justice Ginsburg wrote the decision.

In an 8-1 decision (Souter dissenting) that I agree with the Court said that the property is not subject to the treaty because
1) the jurisdiction of the treaty over the property ceded with the purchase of the land in the open market
2) they waited almost 200 years to assert their demand for exemption. The tribe had no problem with the regulations for most of that time.

Good call. Use it or lose it is the lesson.

That Big Government Loving J. O'Connor

Here is O'Connor (can we trade her for a real conservative?) showing her expand government realm again. O'Connor delivers the opinion that basically say Title IX (the gender equity in sports regardless of public interest law) now can include retaliation for complaining about inequity.

Sorry, I have to agree with the dissenting opinion. "A claim of retaliation is not a claim of discrimination on the basis of sex."

Additionally the dissent states that if someone asserts that there is an implication of the ability to sue under a law then "the statute itself [should] evince a plain intent to provide such a cause of action."

In other words the law should be specific about what is allowed to be sued under a law.

O'Connor, however, again rules in favor of federal government expansion and encouraging the litigation lottery through ambiguous law.

Facts About The Filibuster Ad

People for the American Way Foundation has an ad the completely misstates facts about the Senate Filibuster. (Partisan alert: Given that PAWF is supporting the left it is little surprise that the main tactic is deception.)

Fact Check.org does a great job here explaining how the filibuster has not been used "to do what's right and fair".

They do an even better job of explaining how a filibuster is UNDEMOCRATIC because it gives a minority an un American like disproportionate vote over a majority.
What's actually at stake is whether a minority of 40 senators will continue to have the power to block legislation favored by a majority -- particularly the confirmation of Bush's judicial nominees.
I understand the importance of minority rights, but the filibuster is not balancing minority rights with majority rule, it is allowing minority rights to constantly trump majority rule.

Here is a story about a frat party gone wild (no way!)

So,
California State University Chico has suspended its 25-member chapter of Phi Kappa Tau, while it investigates the party at which professional porn actors were filmed having sex last October, said school spokesman Joe Wills.
Is this REALLY a problem?

I mean, if people are allowed to get paid for "acting" in an adult film then what is the real problem? Seriously. It is not a matter of prostitution then.

From what I understand the frat did not pay the filmmakers or actors, so it is then a question of filming the sex. Again, this is not illegal, is it? I would be shocked if that even violated any of the schools rules.

From what I can figure the only issue is making certain that all of the participants were of age. But it seems that even those bases were covered
who must verify they are older than 18 and sign release forms to be at parties and appear in its "College Invasion" series of films.
All that it seems to be is a moral issue and that should never be the sole matter in a question of government (this is a public institution) intervention.

They knew what they were getting into

This story causes one to take pause.

Four models took a job in New York City posed as wife-beaters. They thought that the ads would have a limited run as well as a limited placement. It turns out that the campaign for which they were hired ran longer and the posters with their faces were placed in a wider location than the models expected.

So, the models are suing the city for $1 Million each.
Copies of the posters were so widespread for so long, that friends of the models believed the men had been arrested and were actual "women beaters"
My question is this: Does the fact that the posters were so widespread for so long change the fact that they knew what the campaign was about?

Is this a case of them trying to get more from the job than the $2K they were paid for the original job? Is this the litigation lottery being attempted again?

Or did the city tell the models '4-months campaign only in the subway stations' and then took advantage of the models by running the campaign for longer and all over the transit system?

And who is really dumb enough to think that the people in the pictures on ads are actually suffering from the ailments in an ad? That guy in the "male-enhancement commercial" is really having size issues? The girl on the credit counselling commercials--you mean she really is not bankrupt?

So, what is the story behind this one?

I laughed when I first read at this headline, but upon further reflection I realized that there are some growing questions that should be answered.

The virtual world is becoming quite the quagmire. Remember the virtual child porn case? The question was if virtual child porn could be outlawed because child porn laws are meant to protect children and virtual child porn presumably does not have a direct harm to children. (Don't attack me, I'm just telling you what the legal question is.)

Now we have virtual weapons that are won in a game. Who owns the "weapon"? It obviously can be sold.

What to do? What to do? The virtual world is becoming increasingly close to needing the same oversight as the real world.

Why Gutknecht should not run for Senate

This vote on the Terri Schiavo bill is more proof why Gutknecht should not run for Senate. He was unable to take a stand on this issue. Too afraid is what I reckon. I would not have voted for him in the general election.

At least there were 261 Congreemen who took a stand. The other 174 (Gutknecht included) did not have the backbone to vote one way or another. Even Betty McCollum, who had so much to say against the bill, did not have the guts to vote agianst it. Shameful.

UPDATE: I may be corrected. From an anonymous poster: "I read in the paper that Gutknecht was on congressional business in europe. He offered to fly back to vote for the bill, but the leadership told him that the legislation would succeed without him."

Judge Greer has consistently ruled against any evidence that would give Terri the benefit of the doubt.
In his ruling, Greer said an affidavit from a neurologist who believes that Schiavo is "minimally conscious" was not enough to set aside his decision to allow the withdrawal of food and water.
That's right, his decision is too good to be re-thought at the advice of an expert ont the matter!

Another gem showing Greer wants death over fact is this:
"By clear and convincing evidence, it was determined she did not want to live under such burdensome conditions and that she would refuse such medical treatment-assistance,"
Yep, the man who needs evidence of his murdering his wife destroyed, Michael Schiavo, said seven years after the incident that she would have wanted to die. 5 years after Michael Schiavo testified that she would want to be kept alive, he changes his tune...he and he alone is considered 'clear and convincing evidence'. Judge "Kill 'em all" Greer stikes truth down again.

And the Vatican condemns each of the decisions made along the way.
A top Vatican official, Monsignor Elio Sgreccia, also criticized the ruling, saying it legitimized a "cruel" death by hunger and thirst for Schiavo. Sgreccia, who heads the Pontifical Academy for Life, told Vatican Radio that he hoped the ruling wouldn't be repeated in other cases.
And then they nailed what is actually happening by
"saying that removing the brain-damaged American woman's feeding tube amounted to capital punishment for someone who has committed no crimes."


I thoguht Terri would have died already. It sounds like she is now showing signs of deep dehydration. But, this is a peaceful way of dying...so why did we help those people who had no water after the Tsunami?

Her Quality Of Life is terrible...so define Quality Of Life please.

If you watch the video of her she is no different than a 6-month old baby with cerebral palsy. Why should we kill her and not the baby?

Why do we think that starvation of lab rats is not acceptable...not humane...yet Terri is going to be killed by "peaceful starvation".

We are killing Terri even though there are very numerous, reasonable and substantial questions surrounding every aspect of her case. Yet a death row murderer is granted a stay because there were questions about the there was a question about if his side was heard correctly.
"Judge Means' order was that nobody's ever heard this guy's competency question," attorney Jack Strickland said. "This guy ought to at least have a chance to put on his evidence."
Yet poor Terri will be killed with so many questions about her.

Is she in a vegatative state? She has not been examined for a few years. The "minimally conscious" diagnosis was not in practice when she was first diagnosed.
What caused her collapse? It was not a heart attack. Bulemia is a candidate, but so is abuse considering the broken bones she had. Considering the testimony of a big fight the night before her collapse and that her friends and family say she was going to tell him that she was divorcing him the day she collapsed.
Could she have recovered? While receiving treatment she was getting better.
Did she want to die? Michael testified that she would want to be kept alive. Then he won the malpractice money, got engaged, got a new lawyer and got a new story...she said while watching a movie that she would not want to live. No one else knows.

The questions go on and on. One question saves a killer. Many questions can not save Terri.

Next time we hear about the children starving to death

From now on when the left bitches about the starving children because of Bush's tax cuts, or the starving people in the sub-Saharan African areas, or the children who are starving because of poverty I will remind them of this fact. Starving to death is peaceful.

Those kids won't suffer. You see, dehydration (the cause of people's hangovers after a couple of hours of dehydration--and those are so wonderful) is not that bad.
Dehydration leads to kidney failure. When the kidneys shut down, levels of certain substances in the blood rise. The person slips into a coma. At some point the biochemical changes in the blood become severe enough to impair the electrical system that controls the functioning of the heart, and the heart stops beating.
Finally, Dr. Russell Portenoy, chair of palliative care at the Beth Israel Medical Center in New York, says that starvation is
"It's usually quite a peaceful death. The person generally looks as if he or she is drifting off to sleep, and then dies."
Hmm, now that I know that I guess there really is no need to every feel bad for those starving kids around the country...it is a peaceful death. Better than 2nd hand smoke...or going to school in Red Lake High School.

My theory on Michael Schiavo

What is Michael Schiavo's motivation?

Of course he would deny outside money.

After reading about 200 pages of court docs last night (including the actual bone scan deposition, other med test reports, etc) I believe there are 2 motives that go hand-in-hand.

1) Michael caused her collapse (and strangulation by hand is not the leading theory). While statute of limitations is done for simple assault, it is never expired for attempted murder (remeber that his first girlfriend after Terri was going to testify but backed out for fear of her life at the hands of Michael). He needs the only remaining evidence (her body) to be disposed of.
2) Money. Money though does him no good (hence turning down over 5
million raised by Glenn Beck alone) if he is in jail.

People's Republic of Minnesota quotes an article whose support for letting Terri die is actually not a Nazi-In-Training arguement.

"Hard cases make for bad law." That is morally defensible by reasonable people...unlike the 'quality of life' crap that the Terri killers spout.

I still disagree, but it is at least a reasonable position and not one that mimics word for word the early Nazi mercy-killing justifications.

BTW, People's Republic of Minnesota has been torn on this subject and the points that are brought up on that blog are also very thoughtful. Kudos for the rational consideration.

I have been calling them Nazis

I have been calling those who want Terri's tube pulled "Nazis in training". Unlike the Democrats who throw that term around like a baseball I have a reason for doing so.

Should we kill a baby whose parents, while still loving the baby, just cannot care for it? The baby is handicap with no hope of recovery, blind, one-arm, one-leg and very mentally retarded. It basically has no higher-brain functions and the quality of life is at best the same as Terri Schiavo when the court first ordered her starved to death.

Should we kill it? It would be mercy killing, the same as Terri. It wishes are known with as much certianty as Terri's.

Should we kill it?

Without fail those whom I ask this question to have said yes.

That is the same answer that Hitler gave. The baby I describe is also known as Baby Knauer.

That baby was the beginning of what turned out to be a slippery slope that was followed...and it is starting all over again.

Should we kill the baby? Should we have killed Terri?

Red Wing school shooting

While tragic there are two things that I keep noticing.

One: Most news reports do not mention that this was an Indian kid. Why not?

Two: Why are we (Americans) sending our police forces in to help them? I thought they were a sovereign nation. The Indian tribes need to decide 100% one way or the other...are they seperate from the United States of America and Minnesota jurisdiction or are they a part of it. This pick and choose crap needs to end.

Tragic as this story is, I think our citizens should NOT go onto the reservation at all. Let them go through the US Embassy and request assistance.

That's right...3 times in 7 paragraphs they flatly declared that Terri's wishes were to die. Let's review the timeline on this.

*In 1990 Terri collapsed.

*His girlfriend at the time remembers that he continually said he did not know what she wanted.
*Michael wins money
*Michael claims that during a viewing of a movie Terri said she would not want to live like "that"

Certainly sounds like her declared wishes, huh.

Did I mention that the bone scans showed that she had a broken back, broken ribs, knees and other broken bones...all from around the time of her collapse?

Excerpt from a report from Dr. Hammesfahr...
In the Emergency Room, a possible diagnosis of heart attack was briefly entertained, but then dismissed after blood chemistries and serial EKG's did not show evidence of a heart attack. Similarly, a pulmonary or lung cause of the disorder was ruled out in the Emergency Room after normal blood gases and Chest X-Rays were obtained. The possibility of toxic shock syndrome was also entertained. The diagnosis of the cause of her condition was unknown.
So, that puts an end to the heart attack story.
"The abnormal potassium level and sugar level were found on admission to the Emergency Room and were successfully corrected by the hospital staff over the next several days. The patient had a difficult hospital course with the development of poorly controlled seizures and prolonged coma state requiring, for a time, ventilator support. However, the staff noted improvement, and it was recommended by several physicians that she be discharged to an intensive rehabilitation center.

She was eventually transferred to Mediplex in Bradenton for intensive rehabilitation. She was poorly responsive. Then her "loving" husband ordered all rehab to cease, all care to cease and no medications to be allowed.

Even after years of the husband ordered neglect the report stated:
"In the spring of 2000, three physicians, including Dr. Jay Carpenter, who is a former Chief of Medicine at Morton Plant Hospital, filed affidavits after observing Ms. Schiavo. All three physicians stated that it is visually apparent that Ms Schiavo is able to swallow and, in fact, does swallow her own saliva.

The patient continued with no physical therapy, communication or speech therapy, or routine medical screening evaluations and treatment such as dental care, mammography, gynecological exams or pap smears during this time."

In 2002
"Cranial nerves were intact, and the patient was able to swallow and handle all secretions."

Because of the years of husband ordered neglect it was difficult to determine if she had control of her limbs. Why? For the amount of pain and loss of control. I have had a cast on my right arm for 3 1/2 months and already can tell that I have a lot of pain in my elbow, loss of about 40% range and significantly less control. That is just 3 1/2 months. After 10 years of that...it would be like I was an invalid, I'm certian.

And as for her vegitative state: "Alertness: The patient was alert throughout essentially the entire exam.

Responsiveness:

The patient would immediately respond to sound, tone of voice and to touch and pain. With respect to responding to those around her, she had limited responsiveness to me personally until approximately 45 minutes into the exam. She started to look at me, against her traditional right gaze preference, about the same time that we started getting significant relaxation in her contracted left arm (the arm that had been contracted for several years.) She appeared to identify the sound of my voice, with the relaxation of the arm. From that point, she would generally look toward the sound of my voice when heard, attempt to find me visually, then track the sound of my voice in its movements, or track me if I was within approximately one foot of her eyes. Prior to that time, she did not track me, or try to locate me visually. When playing music, she had a clear preference to the specific sound track played, and would listen to piano music, but change levels of listening depending on the track played. Her attention to the music would not wander during the track she preferred. She would pick out her mother's voice or her father's voice separate from the music or other voices or sounds in the room, and re-fix her gaze to those people. She would tend not to blink when watching those people. She ignored her husband's loud foot-tapping that went on for approximately five minutes at one point. She also ignored his voice and did not try to seek him out visually when he would at times interject comments during the exam or immediately afterwards.

During various portions of the exam, she would be moved or have her position readjusted. She continued to handle her saliva during this time, never being observed to choke on her saliva."

A right-to-die advocate nails Schiavo's national implication.
It seems to me extremely dangerous to establish a precedent that the next of kin alone can not only make all decisions, supposedly based on a patient's wishes and their medical status, but, then also giving the next of kin sole right to announce what those wishes were and to determine how the patient's condition will be determined. Given the obvious conflicts of interest that can arise over inheritance, etc., such a system invites abuse.
And why is the media doing such a horrible job on this?
While I usually think you conservatives are whining about 'liberal bias', given how important the context is to understanding this case and given how easy that information is to find, I can't help suspecting that the fact that this case came to national attention due to lobbying by the religious right means that the 'elite media' have automatically come down against it...
See, this is not a blue-state/red-state issue. There are some seriously problematic ramifications AFTER the whole denial of due process and murder of Terri are moot.
